A wrongful-death lawsuit against an edibles manufacturer and a retail pot shop in Colorado has been filed on behalf of three boys whose mother was shot to death by her husband, allegedly while he was high from a potent Tootsie Roll–like cannabis candy.
The suit, which appears to be the first of its kind, contends that Gaia’s Garden LLC, the makers of Karma Kandy Orange Ginger, and the Denver-based pot shop that sold it, Nutritional Elements Inc., purposefully failed to warn the accused killer, Richard Kirk, about the candy’s potential side effects.
