Police officers who have to deal with hardened criminals say that they were often met with bullets even before they can approach or arrest suspects. The KwaZulu-Natal police came under the spotlight recently because of the number of suspects that have been killed. At least 40 suspects have been shot dead since April, including more than 20 in July alone. THE Constitutional Court has heard that military courts should be allowed to operate as other courts do in a challenge brought by a military court judge. Military courts currently do not enjoy vital institutional safeguards that apply to all other courts of criminal jurisdiction, according to Lieutenant-Colonel Kevin O’Brien, an instructor at the School of Military Justice. O’Brien’s application concerns three sets of legislative provisions that fail to ensure sufficient structural independence of military courts. He told the apex court that military courts were not independent because the removal of military judges was executive-driven by boards of inquiry. The Defence Act empowers members of the executive to appoint boards of inquiry staffed with non-judicial officers to investigate military judges, their judgments, and the conduct of their cases, according to O’Brien.…

A well-KNOWN businessman is fighting his nephew over a cash inheritance from his late sister. The businessman, Yusuf Cassiem, has filed an application at the Small Claims Court in Bloemfontein, in the Free State, against his nephew, Darren de Villiers, to pay an amount of R20 000 that he allegedly stole from Cassiem’s late sister. Cassiem claimed his sister, who died of dementia last year, instructed her daughter to transfer the amount to him. He said De Villiers was assigned to transfer the money but instead he kept it and sent a fraudulent proof of payment. Cassiem said De Villiers was also appointed to handle the finances.
